End User License Agreement (EULA)

    Effective Date: June 27, 2025

    PLEASE READ THIS AGREEMENT CAREFULLY. By accessing or using the Login.Health platform ("Platform"), you agree to be bound by the terms of this End User License Agreement ("Agreement") between you ("User") and Login.Health, Inc. ("Company," "we," or "us"). If you do not agree to these terms, do not access or use the Platform.

    1. Grant of License

    Login.Health grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial use in accordance with this Agreement and applicable laws.

    2. User Eligibility

    You represent that you are at least 18 years old, or if under 18, are using the Platform with parental or guardian consent. You must have the legal capacity to enter into this Agreement.

    3. Health Information Disclaimer

    THE PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. All content is provided for informational purposes only. Always consult a licensed healthcare provider regarding any medical concerns.

    4. Health Data Use and Privacy

    • User Control: You retain ownership of your personal health information. You control who can access, share, or revoke access to your data.
    • Data Protection: We use industry-standard encryption protocols, including TLS 1.3 for data in transit and AES-256 for data at rest.
    • HIPAA Security Practices: Login.Health is not a Covered Entity or Business Associate under HIPAA, but we voluntarily follow HIPAA security practices and comply with the FTC Health Breach Notification Rule and applicable state and federal privacy laws.
    • De-identified Data: We may use de-identified and aggregated data to improve our services and conduct internal research. This data cannot be linked back to any individual user.

    5. Prohibited Uses

    You agree not to:

    • Reverse engineer, decompile, or disassemble the Platform;
    • Use the Platform for any unlawful or fraudulent purpose;
    • Introduce malware or otherwise disrupt the integrity or performance of the Platform.

    6. Account Termination

    We may suspend or terminate your access at any time for violating this Agreement or applicable laws. Upon termination:

    • Your data will be retained for up to 90 days to allow for export, after which it may be permanently deleted unless required by law to retain longer.

    7. Modifications to the Agreement

    We reserve the right to modify this Agreement at any time. Updated terms will be posted on the Platform with a new effective date. Continued use after updates constitutes your acceptance of the new terms.

    8. Disclaimers and Limitation of Liability

    • The Platform is provided "as is" and "as available," without warranties of any kind.
    • We do not guarantee that the Platform will be uninterrupted, secure, or error-free.
    • To the fullest extent permitted by law, we disclaim all liability for damages resulting from your use of or inability to use the Platform.

    9. Governing Law and Dispute Resolution

    This Agreement shall be governed by the laws of the State of Nebraska, without regard to conflict of law principles. All disputes shall be resolved through binding arbitration in Nebraska, unless prohibited by applicable law.
